The User Agreement set out below (hereinafter the «Agreement») is addressed to an indefinite number of persons — visitors to the websites https://dyvy.tv/, https://ctv.dyvyapp.com/, https://mobile.dyvyapp.com/ and all subdomains of https://dyvy.tv/, https://ctv.dyvyapp.com/, https://mobile.dyvyapp.com/ (hereinafter the «Website») and/or users of the DyvyTV Smart TV application (hereinafter the «Application») for viewing free digital television on the DyvyTV OTT platform (hereinafter the «Platform» / «DyvyTV OTT Platform»), administered by LIMITED LIABILITY COMPANY «UKR-BUSINESS 2000», duly registered and operating under the laws of Ukraine, with its registered address at: Ukraine, 01001, Kyiv, 13 Prorizna Street, premises 77, office 11 (hereinafter the «Administrator», «we», «us»).
This Agreement constitutes a public offer within the meaning of the applicable legislation of Ukraine. The performance by any individual (hereinafter the «User», «you») of conclusive actions aimed at using the Platform shall be deemed unconditional acceptance (acceptance) of all terms of this Agreement. The User acknowledges that acceptance of this Agreement is equivalent to its execution and conclusion on the terms set forth herein. Should any provision of this Agreement be declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.
If you do not agree with this Agreement, you must not use the Platform. Please review this Agreement periodically, as continued use of the Platform following any amendments shall constitute your acceptance of such amendments from the moment they are introduced.
CONSENT TO THE COLLECTION AND PROCESSING OF PERSONAL DATA

SUBJECT OF THE AGREEMENT
This Agreement governs the relationship between the User and the Administrator in connection with the provision of services.
The Administrator provides the User with access to a service enabling free viewing of digital television on the DyvyTV OTT Platform, including but not limited to movies, series, FAST channels, and other streaming multimedia content delivered via Internet broadcasting (OTT) technology (hereinafter “Video Content”), through the Website and/or the Application (hereinafter the “Service”).
In certain cases, access to the Service or specific components thereof may be restricted due to applicable legal requirements or agreements between the Administrator and Video Content rights holders.
This Agreement shall be deemed concluded from the moment the User performs conclusive actions in accordance with Section 3 of this Agreement (“Procedure for Granting Access to the Platform”), pursuant to Articles 640(2) and 642(2) of the Civil Code of Ukraine. PROCEDURE FOR PROVIDING THE SERVICE
To receive the Service, the User must conclude this Agreement with the Administrator.
By performing the actions described in Section 3 of this Agreement, the User confirms that they have reached the age of 21 or another minimum age established by Ukrainian law for access to such services. Individuals who have not reached the required age must refrain from using the Service. Responsibility for violations of this provision by underage individuals shall rest with their parents, adoptive parents, guardians, custodians, or other legal representatives in accordance with Ukrainian law. The Administrator bears no responsibility for verifying the legality of the User’s access.
Use of the Service, any of its features or functions, constitutes the User’s unconditional acceptance of all provisions of this Agreement. Lack of awareness of the Agreement does not relieve the User of responsibility for compliance.
The Administrator determines the conditions of access to the Service in accordance with applicable law and agreements with rights holders. Where restrictions apply, access to relevant functionality shall not be provided.
Where access to the Service requires special conditions, such conditions shall be included in this Agreement and/or communicated via informational messages within the Platform interface.
The Administrator shall not be liable for:
- obstacles affecting access to the Service at the User’s location;
- malfunction of User equipment;
- maintenance or repair works performed by third-party service providers;
- changes in the operating режим of third-party service providers;
- lack of Internet access provided by the User’s Internet service provider.
The Administrator shall also not be liable for unavailability or poor quality of the Service caused by improper use of equipment, power supply failures, network instability, or other unforeseen circumstances.
PROCEDURE FOR GRANTING ACCESS TO THE PLATFORM
General Terms
The Administrator provides access to the Platform in conjunction with advertising materials.
Access is provided within the territory of Ukraine. The User acknowledges that the Administrator may change the Video Content catalog and/or Platform functionality at its discretion without prior notice.
License
Subject to compliance with this Agreement, the Administrator grants the User a non-exclusive, revocable license to use the Platform via the Website and/or Application solely for personal, non-commercial use.
Access via Website
To access the Platform via the Website, the User must visit https://dyvy.tv.
Access via Application
To access the Platform via the Application, the User must download and install the Application on a Smart TV by:
- opening the app store relevant to the TV operating system;
- searching for “DyvyTV”;
- selecting the Application;
- clicking “Download” or “Install”;
- waiting for installation to complete.
The Administrator reserves the right to modify the list of supported Smart TV models by publishing an updated Agreement on the Website.
Consent to Personal Data Processing
Access requires consent via a consent banner displayed upon first visit. The banner records consent status using cookies. Details are provided in the Privacy Policy and Cookie Policy.
Viewing Video Content
Users may watch Video Content free of charge by selecting “Watch” or similar interface elements. Some content requires confirmation of reaching 18 years of age.
ACCESS MODES TO VIDEO CONTENT
- Without Registration — free access to selected Video Content without authorization.
- With Registration — free access after authorization for personalization, advertising targeting, and parental control.
- Age-Restricted Content — access only after confirming age 18.
Sensitive Content includes violence, explicit material, profanity, substance abuse, suicide themes, bullying, gambling, and content encouraging dangerous behavior.
AUTHORIZATION
Authorization is performed by entering a valid mobile phone number and confirming a six-digit SMS code. After authorization, the User gains extended access, subject to age restrictions.
USE RESTRICTIONS
The User agrees not to:
- reverse engineer or decompile the Platform;
- create derivative works;
- upload malware;
- interfere with Platform security;
- test vulnerabilities;
- bypass authentication measures;
- encourage third parties to engage in prohibited activities.
PARENTAL CONTROL
Parental Control allows restricting access to age-restricted content. It is configured by an authorized adult User via PIN codes in the User Account. Minor profiles are part of the main User Account.
RIGHTS AND OBLIGATIONS OF THE ADMINISTRATOR
The Administrator ensures technical access to the Platform within Ukraine. The Administrator may modify content, functionality, restrict access, or terminate access at its discretion and bears no liability for resulting damages.
RIGHTS AND OBLIGATIONS OF THE USER
The User must:
- use the Platform lawfully;
- ensure device compatibility;
- refrain from unauthorized access;
- not use content for commercial purposes;
- provide accurate personal data;
- notify the Administrator of data changes.
The User may terminate this Agreement by notifying the Administrator.
INTELLECTUAL PROPERTY
All Platform content, software, trademarks, and design elements are protected by intellectual property laws and may only be used for personal, non-commercial purposes unless expressly permitted.
Unauthorized use may result in civil, administrative, or criminal liability under Ukrainian law.
TECHNICAL REQUIREMENTS
Access depends on device compatibility, software, and Internet quality. The Administrator is not responsible for equipment damage or incompatibility issues.
LIABILITY AND LIMITATION OF LIABILITY
The Platform is provided “AS IS” and “AS AVAILABLE.” The Administrator provides no warranties and bears no liability for indirect or consequential damages, data loss, service interruptions, or third-party content.
OTHER PROVISIONS
- Amendments take effect upon publication.
- Governing law: laws of Ukraine.
- Jurisdiction: courts of Ukraine.
- Invalidity of any provision does not affect the remainder.
- This Agreement is a public agreement concluded for an indefinite term.
